Proposed Act: The Managerial Mental Fitness Act (MMFA)
Section 1: Title
This Act shall be known as the Managerial Mental Fitness Act (MMFA).
Section 2: Purpose and Scope
The purpose of this Act is to ensure that individuals in managerial positions, who have employees reporting directly or indirectly to them, possess the necessary mental fitness to effectively and ethically lead and manage others. This is to prevent harmful practices, ensure safe working environments, and improve overall workplace productivity and morale.
Section 3: Definition of Manager
For the purpose of this Act, a “Manager” is defined as any individual holding a position of authority who oversees one or more employees, either directly or indirectly. This includes, but is not limited to, individuals with titles such as:
- Supervisor
- Team Lead
- Department Head
- Executive
- Director
- Officer-in-charge
- Any other position of managerial responsibility.
Section 4: Psychological Examination Requirements
- Mandatory Psychological Examination
Every Manager, as defined in Section 3, must undergo a psychological examination conducted by a licensed mental health professional. This examination shall assess the individual’s mental and emotional fitness for managing people in the workplace. - Frequency of Examination
The psychological examination must be taken once upon appointment to a managerial role, and thereafter, every 12 months. The Manager must submit evidence of passing the examination before continuing in their managerial role. - Examination Criteria
The psychological examination shall assess the following:- Cognitive stability and emotional regulation.
- Behavioral patterns conducive to ethical and effective leadership.
- Ability to manage stress and interpersonal relationships within a team.
- Capacity to handle conflict, make decisions, and maintain a productive work environment.
- Mental health screening for conditions that may negatively affect managerial responsibilities.
- Examination Results
- The Manager must pass the examination by demonstrating no significant mental health issues that would hinder their ability to effectively manage employees.
- If the examination reveals issues that may impair performance in the role of Manager, the individual will be required to undergo a treatment or remediation program, followed by a re-evaluation after a prescribed period.
Section 5: Responsibilities of Employers
- Employer’s Obligation
It is the responsibility of the employer to ensure that all Managers undergo the psychological examination as stipulated in Section 4. The employer must facilitate access to licensed professionals and ensure compliance with the examination requirements. - Recordkeeping
Employers must keep records of each Manager’s psychological examination results. These records shall be confidential, stored securely, and made available for inspection by the relevant regulatory bodies upon request.
Section 6: Consequences of Non-Compliance
- Failure to Complete Examination
Any Manager who fails to undergo the required psychological examination within the designated time frame (initial examination and annual follow-up) shall be subject to the following penalties:- A fine of $10,000 for each failure to submit evidence of the examination within 30 days of the due date.
- A further fine of $5,000 per month of continued non-compliance beyond the initial 30-day period.
- Refusal to Undergo Examination
Any Manager who refuses or declines to take the psychological examination as required shall face the following consequences:- Immediate termination of employment.
- A fine of $50,000 for refusal to comply.
- Possible imprisonment for a term of up to 1 year for deliberate and repeated refusal, as determined by the court.
- Failure to Meet Mental Health Standards
If a Manager does not pass the psychological examination due to significant mental health issues that affect their managerial responsibilities:- The individual shall be temporarily suspended from their managerial duties until they have undergone the necessary treatment and a subsequent evaluation proves they meet the required standards.
- If treatment and re-evaluation show no improvement, the Manager may be removed from their managerial position permanently.
Section 7: Appeals Process
Managers who disagree with the results of their psychological examination or the decision made based on the results may appeal to a designated oversight board within 30 days. The board will review the case, including any medical or psychological reports, and issue a final determination.
Section 8: Enforcement and Penalties
- Regulatory Authority
A designated government body shall be responsible for overseeing the enforcement of this Act, including the collection of fines, the management of compliance data, and the investigation of non-compliance or disputes. - Penalties for Employers
Employers who knowingly allow an individual to manage employees without the required psychological examination, or who fail to ensure compliance with the Act, shall be subject to a fine of up to $100,000 per violation.
Section 9: Implementation and Transition Period
- Effective Date
This Act shall be implemented within 12 months from the date of passage. During this period, employers and Managers will be provided with adequate resources to comply with the requirements, including access to accredited psychological examiners and regulatory guidelines. - Grandfather Clause
Managers who are already in position prior to the passage of this Act must undergo their initial psychological examination within 6 months of the Act’s implementation.
Section 10: Miscellaneous Provisions
- Confidentiality
All psychological examination results are to be kept confidential and used solely for the purposes outlined in this Act. Employers are prohibited from disclosing the results to third parties unless required by law. - Cost of Examination
The cost of the psychological examination shall be borne by the employer, who may choose to cover the cost or pass it on to the Manager.
This Act shall take effect immediately upon passage.
