The Fair Service Usage Act
Preamble
An Act to regulate service usages provided by companies that charge a monthly rate to customers, ensuring fairness and transparency in billing practices. This Act aims to protect consumers from excessive charges and ensure they receive credits when they do not meet specified thresholds in their contracts.
Section 1: Definitions
- Service Provider: Any individual or company that offers services to customers for a monthly fee.
- Customer: Any individual or entity that subscribes to a service provided by a Service Provider.
- Threshold: The limit established in a customer’s contract that, if exceeded, results in additional charges.
- Credit: An amount credited to a customer’s account for any shortfall relative to a threshold set by the contract.
Section 2: Credit Entitlement
- Customers shall be entitled to receive a credit for any amount falling short of a threshold established in their contracts with Service Providers.
- The credit shall be calculated based on the difference between the threshold and the actual usage, pro-rated as necessary.
- Service Providers must notify customers of their entitlement to credits upon billing statements that indicate thresholds and actual usage.
Section 3: Compliance and Reporting
- Service Providers must maintain accurate records of customer usage and billing practices.
- An annual report shall be submitted to the regulatory authority detailing compliance with this Act, including credits issued and customer usage statistics.
Section 4: Penalties for Non-Compliance
- Any Service Provider found to have violated this Act shall be fined 100 times the amount overcharged to the customer plus accrued interest from the date of the overcharge.
- Customers shall have the right to report violations to the regulatory authority, which will investigate and enforce compliance.
Section 5: Implementation and Enforcement
- This Act shall take effect 90 days after its passage.
- The regulatory authority shall be responsible for enforcing this Act and may establish additional regulations as necessary to ensure compliance.
Section 6: Severability
If any provision of this Act is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
Section 7: Effective Date
This Act shall be known as the Fair Service Usage Act and shall be effective upon its enactment.
