Act to Prohibit Volume-Based Pricing Practices
Preamble:
This Act aims to protect consumers from coercive sales tactics that promote unnecessary consumption and to foster fair pricing practices in the marketplace.
Section 1: Title
This Act shall be known as the “Fair Pricing Act of 2024.”
Section 2: Definitions
For the purposes of this Act:
a. “Volume discounts” refers to pricing structures that offer lower prices per unit based on the quantity purchased.
b. “Quantity discounts” refers to price reductions offered to customers for buying larger quantities of a single product.
c. “Bulk pricing” refers to any promotional strategy that incentivizes customers to purchase large quantities of goods to receive a lower price per unit.
d. “Business” refers to any entity engaged in the sale of goods or services to consumers.
Section 3: Prohibition of Volume-Based Pricing
a. No business shall offer, advertise, or engage in any form of volume discounts, quantity discounts, or bulk pricing.
b. All pricing for goods and services must remain consistent regardless of the quantity purchased.
Section 4: Exceptions
a. This Act does not apply to:
i. Discounted pricing for wholesale purchases made by other businesses.
ii. Special promotions that are not based on the quantity purchased, such as seasonal sales or loyalty rewards that do not incentivize higher purchases.
Section 5: Enforcement and Penalties
a. Violators of this Act shall be subject to the following penalties:
i. A fine not to exceed $10,000 for first-time offenders.
ii. A fine not to exceed $25,000 for subsequent offenses.
iii. Revocation of business licenses for repeated violations, subject to the discretion of regulatory authorities.
b. Consumers may file complaints against businesses they believe are violating this Act with the appropriate regulatory agency.
Section 6: Effective Date
This Act shall take effect six months after its passage to allow businesses adequate time to adjust their pricing practices.
Section 7: Review
a. The effectiveness of this Act shall be reviewed by the appropriate regulatory body every two years, with recommendations for amendments as necessary.
