Hunting and Fishing Access Act
An Act to Regulate Hunting and Fishing with Special Provisions for Low-Income Individuals
Section 1: Purpose
This Act is established to promote equitable access to hunting and fishing opportunities for individuals in the lower economic tiers, ensuring that these activities remain accessible to those in need.
Section 2: Definitions
- Hunting: The act of pursuing and capturing or killing wildlife.
- Fishing: The act of catching fish or other aquatic animals.
- Net Worth: The total value of an individual’s assets minus their liabilities.
- Income: The total earnings of an individual from all sources.
Section 3: Eligibility for Free Hunting and Fishing
- Income Threshold: Individuals in the lower 33% of net worth or income are eligible for free hunting and fishing privileges.
- Verification: Eligibility shall be determined through appropriate financial documentation, which must be presented when applying for a license.
Section 4: Licensing
- Free Licenses: Eligible individuals must obtain a hunting and/or fishing license, which shall be provided free of charge.
- License Validity:
- Each hunting license permits the taking of one Big Game animal or 24 Small Game animals per season.
- Fishing licenses allow for unlimited fish catches per year.
- Non-Breeding Seasons: Eligible individuals may hunt only during designated non-breeding seasons.
Section 5: Regulations for Higher Income Individuals
- Compliance: Individuals with net worth or income above the lower 33% must adhere to all state hunting and fishing laws and regulations.
Section 6: Enforcement and Penalties
- Violations: Individuals found in violation of this Act shall face the following penalties:
- Fines: Monetary fines will be assessed based on the nature and severity of the violation.
- License Suspension: Violators shall be prohibited from obtaining a hunting and fishing license for a period of five years.
Section 7: Implementation and Oversight
- Regulatory Authority: This Act shall be enforced by state wildlife and fisheries agencies, which will oversee licensing, compliance, and enforcement activities.
Section 8: Severability
- If any provision of this Act is found to be invalid or unconstitutional, the remaining provisions shall continue in full force and effect.
Section 9: Effective Date
- This Act shall take effect 180 days after passage and approval to allow for the establishment of necessary administrative procedures.
This proposed Act aims to enhance access to hunting and fishing for economically disadvantaged individuals while ensuring responsible management of wildlife resources.
