The Legislative Integrity Act
Section 1: Purpose and Findings
The purpose of this Act is to eliminate the practice of filibusters by publicly elected officials, ensuring that legislative processes are efficient, transparent, and accountable. The findings of Congress include:
- Filibusters often obstruct legislative progress and undermine democratic processes.
- The ability to prolong debate through filibusters can lead to gridlock, preventing timely decision-making.
- A commitment to efficient governance is essential for public trust and effective representation.
Section 2: Definitions
For the purposes of this Act:
- “Filibuster” refers to any attempt by an elected official to prolong debate or delay a vote on legislation through extended speaking or procedural tactics.
- “Initiating a filibuster” is defined as:
- Mentioning a filibuster in any official capacity.
- Speaking with others about the intent or strategy of a filibuster.
- Suggesting or demanding a filibuster.
Section 3: Prohibition of Filibusters
- The practice of filibustering is hereby outlawed for all publicly elected officials.
- No elected official shall initiate, participate in, or condone a filibuster for any reason.
Section 4: Penalties for Violations
- Any elected official found guilty of initiating or taking part in a filibuster shall be immediately removed from their elected office.
- Such officials shall be permanently banned from holding any future public office.
- Additional penalties may include:
- Fines up to $100,000.
- Imprisonment for a term not exceeding five years.
Section 5: Enforcement and Compliance
- The appropriate legislative ethics committee shall oversee the enforcement of this Act.
- Complaints regarding violations may be submitted by any member of the public, and investigations shall be conducted promptly.
Section 6: Severability
If any provision of this Act is found to be unconstitutional or otherwise invalid, the remaining provisions shall remain in effect.
Section 7: Effective Date
This Act shall take effect immediately upon enactment.
