Fair Misconduct Training Act
Section 1: Short Title
This Act may be cited as the “Fair Misconduct Training Act.”
Section 2: Purpose
The purpose of this Act is to protect the rights of individuals by prohibiting mandatory misconduct training for those not formally convicted of the misconduct being addressed.
Section 3: Definitions
For the purposes of this Act:
(a) “Employer” means any person or entity that employs individuals in the United States.
(b) “Educational Institution” means any public or private entity that provides education, including schools, colleges, and universities.
(c) “Misconduct Training” refers to any program designed to prevent, address, or educate individuals about misconduct, including but not limited to harassment, discrimination, and ethical violations.
(d) “Conviction” means a formal judgment of guilt rendered by a court of law.
Section 4: Prohibition of Mandatory Misconduct Training
(a) No employer or educational institution shall require any individual to participate in misconduct training unless that individual has been formally convicted of the specific misconduct related to the training.
(b) Individuals may voluntarily participate in misconduct training, but such participation cannot be a condition for employment or enrollment unless the criteria specified in subsection (a) are met.
Section 5: Penalties for Violations
(a) Any employer or educational institution found to be in violation of this Act shall be subject to fines.
(b) The fines shall be the lesser of:
(1) 10% of the employer’s or institution’s annual gross profit; or
(2) $100,000.
Section 6: Enforcement
(a) The Department of Labor and the Department of Education shall be responsible for the enforcement of this Act.
(b) Individuals who believe they have been subjected to a violation of this Act may file a complaint with the appropriate agency, which shall investigate and take necessary action.
Section 7: Effective Date
This Act shall take effect 180 days after its enactment.
Section 8: Severability
If any provision of this Act is found to be unconstitutional or otherwise invalid, the remaining provisions shall remain in full force and effect.
This proposed Act aims to safeguard individual rights while ensuring that misconduct training is only mandated in cases of proven wrongdoing and those who have not displayed any misconduct are
not punished by being subjected to misconduct training.
