Customer Late Fee Act
Section 1: Title and Purpose
This Act shall be known as the “Customer Late Fee Act” and aims to empower customers by allowing them to charge late fees on overdue products, services, and payments owed by any commercial or government entity.
Section 2: Definitions
- Customer: An individual or entity that receives products, services, or payments from a commercial or government entity.
- Sender: A commercial or government entity that provides products, services, or payments to a customer.
- Overdue: Any product, service, or payment not delivered or paid by the promised date and time.
- Grace Period: A maximum period allowed for late payment or delivery before late fees are applied.
- Incorrect Delivery: Any product, service, or payment that does not meet the terms agreed upon or is otherwise flawed.
Section 3: Late Fee Structure
- Late Fees: Customers may charge a late fee not exceeding 15% of the price, cost, or payment due per day for any overdue item.
- Additional Late Fees: If payment is not made within 45 days of the original due date, an additional late fee of 15% per day will be applied until all amounts owed, including late fees, are settled.
- Grace Period: A grace period of 5 days shall be provided for all overdue products, services, and payments before late fees begin to accrue.
Section 4: Notification Requirements
- Notification of Incorrect Delivery: Customers must notify the sender of any incorrect product, service, or payment received within 5 days of receipt.
- Failure to Notify: If a customer fails to notify the sender within the specified 5 days, their claim to late fees will be deemed invalid.
Section 5: Non-Return of Incorrect Deliveries
Customers are not required to return any incorrectly delivered products, services, or payments that do not meet the agreed-upon terms.
Section 6: Applicability
This Act applies solely to domestic products, services, and payments, and does not extend to international transactions or any products, services, or payments that are not delivered or provided to customers in compliance with this Act.
Section 7: Enforcement and Compliance
- Enforcement: The provisions of this Act shall be enforced by the appropriate regulatory bodies, which shall ensure compliance by commercial and government entities.
- Dispute Resolution: Customers and senders may seek mediation or arbitration to resolve disputes arising under this Act.
Section 8: Severability
If any provision of this Act is found to be invalid or unenforceable, the remaining provisions shall continue to be in full force and effect.
Section 9: Effective Date
This Act shall take effect 90 days after its enactment.
