Citizen’s Right to Sue Act
An Act to allow U.S. citizens to file lawsuits against local, state, and federal governments, ensuring accountability and protection of citizens’ rights.
Section 1: Short Title
This Act may be cited as the “Citizen’s Right to Sue Act.”
Section 2: Findings
The Congress finds that:
- Citizens have the right to seek redress for grievances against government entities.
- Allowing lawsuits against the government promotes accountability and transparency in governance.
- Ensuring a fair legal process reinforces the rule of law and protects citizens’ rights.
Section 3: Definitions
For the purposes of this Act:
- “Petitioner” refers to any U.S. citizen filing a lawsuit against a government entity.
- “Government” includes local, state, and federal government entities and their representatives.
Section 4: Right to File Lawsuits
- All U.S. citizens shall have the right to file lawsuits against local, state, and federal governments for actions or omissions that violate their rights.
- Lawsuits shall be filed in courts located within the jurisdiction of the petitioner.
Section 5: Jury Composition
- Lawsuits under this Act shall be tried before a jury composed of 9 members, selected from the petitioner’s locality.
- The jury shall be responsible for determining the facts of the case and rendering a verdict.
Section 6: Outcomes and Legislative Action
- If the government loses a lawsuit against a U.S. citizen, the court shall mandate the creation of a law preventing future unlawful acts related to the case in question.
- This new law shall be proposed and enacted by the appropriate legislative body within 90 days of the court’s decision.
Section 7: Consequences for Government Representatives
- If a lawsuit is ruled in favor of the petitioner against an individual or individuals representing the government, those individuals shall:
a. Be fined an amount determined by the court, based on the severity of the violation.
b. Lose their current position in government.
c. Be permanently banned from holding any future positions within government entities at any level.
Section 8: Protections for Petitioners
- No petitioner shall face retaliation or discrimination for filing a lawsuit under this Act.
- Any acts of retaliation shall be subject to additional legal action and penalties.
Section 9: Funding and Support
- The federal government shall provide resources to assist citizens in navigating the legal process, including access to legal aid and information about their rights.
- State and local governments are encouraged to establish similar support programs.
Section 10: Effective Date
This Act shall take effect immediately upon its passage.
Section 11: Severability
If any provision of this Act is held to be unconstitutional or otherwise invalid, the remaining provisions shall continue in full force and effect.
