Cancellation Fairness Act
Preamble
An Act to protect consumers from unjust charges by service providers following a cancellation of services, ensuring fair treatment and transparency in contractual agreements.
Section 1: Definitions
- Business: Any entity providing services for a fee, including but not limited to, subscription services, memberships, and professional services.
- Customer: An individual or entity that enters into a service agreement with a business.
- Cancellation Date: The date and time a customer formally notifies a business of their intent to cancel a service.
- Contract: An agreement between a customer and a business for the provision of services.
- Prorated Charge: A charge calculated based on the portion of the service period used, relative to the full service period.
Section 2: Customer Cancellation Rights
- Upon notifying a business of cancellation, a customer shall not incur any charges for services beyond the cancellation date and time.
- If a contract remains unfulfilled at the time of cancellation, the business may charge the customer for a maximum of 30 days following the cancellation date.
- Should this 30-day period span two different calendar months, the charge for the incomplete month shall be prorated.
Section 3: Enforcement and Penalties
- Any business found to be in violation of this Act shall incur fines amounting to 10 times the monthly payment of the contract for each day the violation continues beyond the original cancellation date.
- Fines shall be assessed and collected by the appropriate regulatory body responsible for consumer protection.
Section 4: Implementation
- This Act shall take effect 90 days following its enactment.
- Businesses shall be required to update their cancellation policies to align with this Act and communicate these changes to customers.
- The regulatory body shall develop guidelines for enforcement and provide public education on the rights established under this Act.
Section 5: Severability
If any provision of this Act is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
Section 6: Review
This Act shall be reviewed every three years to assess its effectiveness and make necessary adjustments.
