Section 1: Definitions

- Grace Period: A designated timeframe during which a customer may cancel an auto-renewal without incurring charges.

Section 2: Prohibition of Default Auto-Renewals
- Businesses shall not automatically enroll customers into auto-renewal agreements by default.
- Customers must explicitly choose to opt-in to auto-renewal services; such options must be clearly presented and easily accessible.
Section 3: Grace Period
- After an auto-renewal takes effect, customers shall have a grace period of 5 business days from the first billing period during which they may cancel the auto-renewal without incurring any charges.
- Businesses must inform customers of their right to cancel during this grace period at the time of renewal notification.
Section 4: Enforcement and Penalties
- Any business found in violation of this Act shall incur fines, the amount of which shall be determined by the appropriate regulatory body responsible for consumer protection.
- The fines for violations shall be assessed based on the severity and frequency of the offenses, with a minimum penalty of $500 per violation.
Section 5: Implementation
- This Act shall take effect 90 days following its enactment.
- Businesses shall be required to update their policies regarding auto-renewals to comply with this Act and communicate these changes to customers.
- The regulatory body shall develop guidelines for enforcement and provide public education on the rights established under this Act.
Section 6: Severability
If any provision of this Act is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
Section 7: Review
This Act shall be reviewed every three years to assess its effectiveness and make necessary adjustments.
